Apparently, there was a difference in understanding which homophone was in the Constitution. That's understandable because the longhand version is so much harder to read than the digital version in a nice Arial font.
Here is a question for Elena Kagen: how would you have voted?
Better yet:
Take the last 20 Supreme Court decisions and ask her, under oath, how she would have voted. No equivocation allowed. "Ms. Kagen, how would you have voted on [this] issue?"
If she attempts to answer, "I can't answer that without reading all of the documentation from each case," then she is unprepared and unqualified. Otherwise, let her answers, under oath, reveal her understanding and biases... one way or another.[source]
