The U.S. Supreme Court voted 5-4 that individuals have to declare that they want to remain silent in order to have the right to remain silent. Full article in The New York Times.
I left a comment there:

I should not have to declare that I want the right of free speech in order to exercise it. I should not have to declare that I want to own a gun to own one. I should not have to declare that I don't want to incriminate myself in order to exercise that right.
The legal system perversely infringes on our rights in many ways. Liberals selectively argue for individual rights; conservatives selectively argue for individual rights. Liberals and conservatives selectively argue for different individual rights. Neither are consistent.
It should be the responsibility of the justice system to ensure that IT does not violate any constitutional right and it should be the responsibility of the Supreme court to NOT attempt to find the nit to pick that allows violation of those rights
